PETITION REGARDING FOUR ABOVE-GUIDELINE RENT INCREASE APPLICATIONS

Rosebury Square – AGIs Filed May 2025

In May 2025, Nubury Properties Ltd. filed four Above-Guideline Rent Increase (AGI) applications affecting multiple buildings within the Rosebury Square complex, including 140 Elm Ridge Dr., 111 Ridelle Ave., 141 Lyon Ct., 377 Ridelle Ave., and 145 Marlee Ave.

These applications cite significant capital expenditures, including:

  • Underground garage repairs
  • Roof replacement and related structural work
  • Additional large-scale building system repairs

Tenants recognize that capital repairs may be necessary and may qualify under Ontario’s Residential Tenancies Act where they extend the useful life of a building.

However, these applications were filed at a time when residents continue to experience ongoing service instability, including:

  1. Persistent water accumulation and drainage issues in the underground garage
  2. A pattern of elevator disruptions over the past two years
  3. Heating and hot water interruptions
  4. Boiler room water-related incidents
  5. Service instability affecting daily living and accessibility
  6. Loss of access to the swimming pool amenity
  7. Malfunctioning or inconsistent operation of building exhaust systems
  8. Ongoing construction-related access limitations affecting movement throughout the property
  9. Ongoing concerns regarding ventilation in the underground parking garage

Residents have raised these concerns and sought engagement with the property management. A meeting was requested to discuss the ongoing service disruptions and the implications of the four AGI applications. While a meeting was proposed, it did not ultimately take place, and residents have not been provided a structured opportunity for collective discussion of these issues.

When four AGIs are filed simultaneously across the complex, the cumulative financial impact on residents is significant.

Rosebury Square is home to seniors, working families, long-term tenants, and individuals living with disabilities. Elevator outages affect mobility. Heating disruptions affect safety. Service instability affects quality of life and accessibility.

Tenants are seeking clarity and accountability regarding:

  • The timing and coordination of the four applications
  • Whether the expenditures reflect preventative infrastructure planning
  • How ongoing service disruptions will be resolved
  • How residents will be protected from compounded financial burden

Under the Residential Tenancies Act, Above-Guideline Rent Increases are intended for eligible capital expenditures that extend the useful life of a building, not routine maintenance or the repair of ongoing service deficiencies.

Residents are calling for:

  • Accessible, building-specific clarification of the expenditures cited in each AGI application
  • Clear timelines for addressing unresolved service concerns
  • A commitment to stabilizing core services
  • Meaningful engagement with tenant representatives

This petition is being shared with local elected officials, housing advocates, and relevant community stakeholders in the interest of transparency and public accountability.
